Consumer Financial Protection Bureau Forms Required by January 1, 2013

Pursuant to the Dodd‐Frank Wall Street Reform and Consumer Protection Act, the Consumer Financial Protection Bureau (“CFPB”) has assumed responsibility for rulemaking and enforcement of the Fair Credit Reporting Act (“FCRA”) in place of the Federal Trade Commission (“FTC”). As such, the CFPB has issued the following three revised notices, which go into effect on January 1, 2013.

• A Summary of Your Rights Under the Fair Credit Reporting Act: The FCRA requires that Credit Reporting Agencies, also known as background screening companies, (“CRA(s)”) provide this form to employers. Additionally, employers must provide this form to applicants and employees before the applicant or employee will be the subject of an investigative consumer report (background check) and prior to taking adverse action against an employee or applicant based on the consumer report (provided with the Pre-Adverse Action letter). • Notice to Users of Consumer Reports: Obligations of Users Under the FCRA: The FCRA requires that CRAs provide each user, including their employer clients, with a copy of this notice. To view Notice, click here:

• Notice to Furnishers of Information: Obligations of Furnishers Under the FCRA: The FCRA requires that CRAs provide this notice to furnishers who provide information to the agencies. (This form is not relevant to employers.) The primary change in these forms directs consumers, furnishers, and users of employee background checks to the CFPB instead of the FTC. Employers are required to utilize the above forms entitled, “A Summary of Your Rights Under the Fair Credit Reporting Act” and “Notice to Users of Consumer Reports: Obligations of Users Under the FCRA” by January 1, 2013.

Although the FTC retains general supervisory authority over CRAs, in July 2012 the CFPB adopted a rule allowing it to supervise CRAs that are “larger participants” in the consumer reporting market (defined as those that have more than $7 million in annual receipts from consumer reporting activities).

A prior version of the above Summary and Notices published in December of 2011 by the CFPB have been circulated to employers and Human Resource professionals by various law firms and other organizations over the past several months. On November 14, 2012, the CFPB acknowledged that these older documents contain typographical and other technical errors. Therefore, the CFPB published the above new forms correcting the errors.

The Planning Analyst  supports an interdisciplinary team dedicated to bringing affordable energy efficient products and services to market in a sustainable manner.  This position is responsible for the quantiative modeling to develop market projections and related energy savings forecasts, cost-benefit analysis, and other value metrics for programs within NEEA’s portfolio.  This role is highly cross-functional and requires analyzing perspectives from various functions and sources and effectively communicating valuation modeling assumptions and results.  The Planning Analyst will also support the department with key deliverables for reporting energy savings and other value metrics for our internal and external stakeholders.  Reporting of results are subject to the highest level of scrutiny by board and commissions.  

Salary range: $70,000 - $77,000 exempt

The Typical Day May Include…

  • Meeting with program teams to discuss the latest market research and evaluation results and how these results will influence future program direction and resulting energy savings forecast.
  • Researching models and assumptions from our Northwest Power and Conservation Council to investigate methodology and technical assumptions and build the case of efficiency potential for a program.
  • Presenting information to our Advisory Committees to discuss assumptions used for reporting efficiency within the community of funders.
  • Estimating the ‘what if’s’ of a program to establish the range of potential market adoption of emerging technology in energy efficiency products.
  • Meeting with your market research and evaluation partner to define what questions need to be answered in the next round of research in order to better inform your forecasting assumptions.

You Likely Have The Following Experience:

  • Performing modeling, analysis and synthesis using data. 
  • Ability to identify right questions to ask to translate logic model, initiative strategy and objectives and market research and evaluation reports to get best estimate of forecasted adoption and savings, identify gaps/needs in data, create trend analysis, sensitivity analyses, and risk and opportunity assessments, and provide supporting recommendations to guide boundaries and associated decision making.
  • Ability to understand data structure and generate reports to synthesize data appropriately via database technology.
  • Manages to high level of modeling detail, understands application of technical energy efficiency modeling components such as load shapes, costs, first year savings and retirements, Power plan measures, level of rigor for assumptions.
  • Working with others to collaborate on program needs and outcomes.

Your Education, Experience, and Skills:

  • A minimum of 4 years of experience in financial planning or analysis, operations research, and/or economic analysis and modeling required.
  • Bachelor's Degree in Economics, Finance, Business Administration, Public Administration, or related field required.
  • Prior experience with Commercial Building, Industrial manufacturing, or Residential homes a plus. 
  • Experience applying quantitative and qualitative methods. 
  • Strong Word and PowerPoint skills.
  • Even Stronger Excel skills. 
  • Strong investigative and exploratory skills. 
  • Able to navigate competing opinions to generate forecasted savings. 
  • Ability to do a combination of communications, coordination, documentation, and detailed technical work in a fast-paced environment. 
  • An equivalent combination of education, experience and training that would provide the knowledge, skills, and abilities required for the successful performance of the essential job duties will also be considered.
